HeartWhisper ("we", "our", or "the App") is committed to protecting your privacy. This Privacy Policy explains how we handle your information when you use our mobile application. We believe that emotional expression should never come at the cost of your privacy.

2. Information We Collect

We collect no personal data on external servers. HeartWhisper is designed to keep everything on your device. The following information is stored locally on your device only:

  • Your profile (avatar, nickname, signature)
  • Your posts (titles, content, categories, timestamps)
  • App preferences and settings

We never receive, store, or have access to this information. No cloud, no servers, no third-party sharing.

3. How We Use Information

Since all data remains on your device, we do not:

  • Access, view, or collect your personal information
  • Share any data with third parties
  • Use analytics, trackers, or advertising SDKs
  • Transmit any data over the internet

4. Camera & Photo Library Access

If you choose to upload a custom avatar from your photo library, the App requests access to your device's photo library. This access is used solely to select an image for your local profile. The image is stored locally on your device and is never uploaded to any server. You can deny this permission and still use the app with default avatars.

5. No Tracking & Analytics

HeartWhisper contains absolutely no tracking mechanisms. We do not use:

  • Google Analytics or Firebase
  • Crashlytics or any performance trackers
  • Advertising identifiers (IDFA, GAID)
  • Cookies or persistent web trackers

6. Children's Privacy

HeartWhisper does not knowingly collect any personal information from children under 13. The app is designed to be safe and private for all ages. All content creation is user-initiated and stored locally. If you are a parent and believe your child has used the app, rest assured that no data leaves the device.

7. Data Security

Because all data remains on your local device, you maintain full control over its security. We recommend keeping your device's operating system updated and using device-level security features (passcodes, biometrics) to protect your information.

8. Your Rights & Control

Since your data never leaves your device, you retain absolute ownership and control. You can:

  • Edit or delete your profile at any time
  • Delete individual posts you have created
  • Uninstall the app to remove all associated data

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect clarifications or improvements. Any changes will be reflected in the App and on this page with an updated effective date. Continued use of HeartWhisper after changes constitutes acceptance of the revised policy.

1. Acceptance of Terms

By downloading, accessing, or using HeartWhisper ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. User Responsibilities & Content

You are solely responsible for all content you create, post, or store within the App. You agree not to create or store content that:

  • Violates any applicable local, state, national, or international laws
  • Contains hate speech, harassment, threats, or defamation
  • Promotes violence, self-harm, or illegal activities
  • Contains explicit, obscene, or pornographic material
  • Infringes upon the intellectual property rights of others
  • Impersonates another person or entity

Local-Only Nature: HeartWhisper stores all content locally on your device. We do not host, moderate, or have access to your content. You are solely responsible for your own creations and any consequences under applicable laws.

3. Age Requirement

You must be at least 13 years old to use HeartWhisper. If you are between 13 and 18 years old, you confirm that you have obtained parental or guardian permission to use the App. We do not knowingly collect any information from children under 13.

4. Intellectual Property Rights

Our IP: The App's code, design, user interface, logos, graphics, and visual elements are owned by HeartWhisper and are protected by copyright and other intellectual property laws. You may not copy, modify, reverse engineer, decompile, or create derivative works of the App or any part thereof.

Your Content: You retain all ownership rights to the content you create within the App. We claim no ownership over your user-generated apologies, thanks, confessions, or profile information.

Third-Party Assets: The App uses open-source components including DiceBear Avataaars (MIT License) as detailed in the Open Source Licenses section within the App.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the App will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of any content

You assume full responsibility for your use of the App and any content you create.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEARTWHISPER AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, content, profile information, or posts
  • Device damage, malfunction, or performance issues
  • Emotional distress or psychological impact arising from content you create or view within the App
  • Any claims arising from third-party interactions (as the App does not enable real-time social networking)

7. App Store & Platform Compliance

HeartWhisper complies with:

  • Apple App Store Review Guidelines (no data collection, no account requirement)
  • Google Play Developer Program Policies (listed under "No Data Collected" category)

8. Termination & Modification

We reserve the right to discontinue, modify, or update the App at any time without prior notice. We may also update these Terms of Service periodically. Continued use of the App after changes constitutes acceptance of the modified terms. You may terminate your use of the App at any time by uninstalling it from your device.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved individually.
